MahaRERA orders Riverview City to pay interest for a 4-month possession delay at Falcon Towers

At Falcon Towers (Riverview City, Pune), a buyer who paid Rs 88.99 lakh for Flat A-1901 was promised possession by April 30, 2025 but did not receive it until August 27, 2025 – after the Occupation Certificate finally came through on June 2, 2025. MahaRERA Member Ravindra Deshpande rejected the developer’s attempt to invoke a force majeure defence for approval delays.

The ruling held that a developer cannot “retrospectively rely on statutory approval delays” without ever formally revising and communicating a new possession date to the buyer. Riverview City Constructions was ordered to pay interest (SBI’s highest MCLR + 2%) for the delay period, plus Rs 20,000 toward the buyer’s complaint costs.

The buyer-education takeaway is clean: a developer cannot simply blame government approvals after the fact to escape a missed possession date – the obligation is to formally revise and communicate a new one. If your possession is delayed, hold on to your agreement’s committed date and all communications; RERA exists for exactly this.
